1. INTRODUCTION GymRatX LLC (“GymRatX”) respects the intellectual property rights of others and expects users to do the same. This Copyright & DMCA Policy describes how copyright owners may report alleged infringement under the U.S. Digital Millennium Copyright Act (“DMCA”). 2. REPEAT INFRINGERS In appropriate circumstances, GymRatX may terminate accounts of users determined to be repeat infringers of third-party copyrights. 3. NOTICE OF CLAIMED INFRINGEMENT If you are a copyright owner or authorized agent and believe that content on the Platform infringes your copyright, you may submit a written DMCA notice that includes: (a) Your physical or electronic signature; (b) Identification of the copyrighted work claimed to have been infringed or a representative list of such works; (c) Identification of the allegedly infringing material and information reasonably sufficient to allow us to locate it on the Platform; (d) Your contact information, including name, address, telephone number, and email address; (e) A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and (f) A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on its behalf. 4. DESIGNATED COPYRIGHT AGENT Contact information for GymRatX’s designated copyright agent will be posted on the GymRatX website. DMCA notices must be directed to that agent as indicated there. 5. COUNTER-NOTIFICATION If you believe that content you posted was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notification to our copyright agent that includes: (a) Your physical or electronic signature; (b) Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before removal; (c) A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled due to mistake or misidentification; and (d) Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your judicial district (or Montgomery County, Maryland, if you reside outside the United States) and that you will accept service of process from the person who provided the original DMCA notice or that person’s agent. 6. REMOVAL AND RESTORATION OF CONTENT Upon receipt of a valid DMCA notice, GymRatX may remove or disable access to the allegedly infringing material. When appropriate, we will attempt to notify the user who posted the material. If a valid counter-notification is received, we may restore the material unless the copyright owner files a legal action within the period specified by law. 7.
